Supreme Court Allows Allegations Of Prior Term Misconduct To Be Considered In District Attorney Removal Case

The state Supreme Court issued an order on Friday allowing allegations of misconduct in a prior term of McKinley County District Attorney Bernadine Martin to be considered in proceedings to remove her from office. The Court had directed Martin and the State on Oct. 17 to submit legal arguments on whether a district attorney could be removed only for misconduct that occurred during a current term. In Friday’s order, the Court rejected the term issue as a defense for Martin in the case. The Court will release a written opinion later on the matter.

A trial before the justices in the removal case is scheduled for Dec. 1-3.
