Crystal Padilla, 34, of Santa Fe will remain incarcerated until Oct. 19 after her fourth violation of her probation. Padilla entered into a plea bargain in October 2016 and was found guilty of attempting to commit a felony by unlawful taking of a motor vehicle.
Probation Officer Linda Pena told Los Alamos Magistrate Judge Pat Casados June 29 that Padilla’s most recent violation involved being found overdosing by her son on a bathroom floor. Padilla ended up being hospitalized for several days. Pena said Padilla had several opportunities for outpatient treatment and had not succeeded with them.
Defense attorney Tyr Loranger said his client was prepared to admit the violation in open court. Judge Casados revoked Padilla’s probation and ordered her to remain in jail until October. She suggested to Padilla that she take advantage of programs available through the jail and informed her that she would receive a dissatisfactory discharge from probation.
A pre-trial hearing for Casandra Ruybal on a charge of driving on a suspended license was continued to Oct. 5.
Charges of driving while under the influence of liquor and/or drugs, first offense, against Genevieve Early were dismissed without prejudice by District Attorney Kent Wahlquist pending test results .
Judge Casados indicated a bench warrant would be issued for Mark Morrow for failure to appear for a pre-trial hearing on charges of use or possession of drug paraphernalia and possession of marijuana or synthetic cannabinoids. From online court records, it appears the warrant was quashed Friday and the pre-trial hearing is rescheduled for July 27.
A bench warrant was issued for Abelardo Fernandez who failed to appear for a pre-trial hearing on shoplifting charges.
A status hearing for Garrett Eckhart was continued as well as a pre-trial hearing for Andrew Atencio.
Preliminary hearings were set for Jimmy Romero, John J. Lerma, Joseph Gonzales, Eric Sanchez, Mario Cervantes-Ortega and Andrea Rivera.
